Chapter 195, Statutes of 2026

Jury service exemptions

Starting January 1, 2028, Californians age 80 or older with a permanent medical impairment can obtain a permanent jury-service excuse through a written attestation.

The law removes the requirement for a treating health care provider’s supporting note for these seniors, while retaining the general rule that jury-service excuses require undue hardship.

What the law does

  • Requires courts to permanently excuse an eligible person age 80 or older who gives the jury commissioner a written attestation that an impairment permanently prevents jury service.
  • Bars courts from requiring additional medical documentation for that permanent excuse.
  • Allows the Judicial Council to update court rules and forms to implement the change.

Who it affects

  • Eligible prospective jurors age 80 or older with impairments that permanently prevent jury service.
  • Jury commissioners and courts handling requests for permanent jury-service excuses.

Context

The new process becomes operative January 1, 2028.
