Education-related positions: previous employment disclosures: Commission on Teacher Credentialing: unprofessional conduct

AB 1381 makes complete prior-school-employment disclosures and required misconduct-history checks enforceable professional duties.

The law strengthens hiring safeguards intended to ensure schools identify prior reports of egregious misconduct before employing staff. Certificated applicants and school leaders can face credential discipline for noncompliance.

What the law does

  • Treats a certificated applicant’s failure to list every prior school employer as unprofessional conduct subject to Commission on Teacher Credentialing action.
  • Bars district and county superintendents and charter and private school chief administrators from hiring certificated or noncertificated staff before completing required employment-history inquiries.
  • Requires those leaders to ensure the inquiries are completed and makes noncompliance unprofessional conduct subject to Commission on Teacher Credentialing action.
  • Provides state reimbursement procedures if the Commission on State Mandates finds the new local duties create reimbursable state-mandated costs.
