Weights and measures: electric vehicle fueling systems

The law creates a framework to verify that chargers measuring electricity sold to drivers meet accuracy and other requirements. It also streamlines installation of qualifying factory-tested systems.

What the law does ​

• Requires the Secretary of Food and Agriculture to update EV charging-system regulations by July 1, 2028, in consultation with the State Energy Resources Conservation and Development Commission.
• Allows county sealers to inspect commercial EV charging systems through either risk-based statistical sampling or the otherwise applicable inspection schedule, while permitting complaint-based inspections at any time.
• Requires sealers to seal compliant systems, immediately remove systems that fail type-approval or accuracy-tolerance requirements from service, and report removals monthly to the Division of Measurement Standards.
• Requires notice and a correction period before sealers remove systems from service for other deficiencies, unless the deficiency is not acknowledged within 30 days and fixed within 45 days or an extension.
• Exempts qualifying factory-tested and certified systems from field placement-in-service and initial field accuracy-testing requirements.
• Requires operators to report qualifying systems' installation within 72 hours and register them with the county sealer.
• Limits meter- or accuracy-affecting repairs to registered service agencies or agents, while allowing competent persons to make other repairs if they notify the sealer within one week.

Context ​

The Division of Measurement Standards must share EV charging inspection data with the State Energy Resources Conservation and Development Commission at least twice a year.
