Family temporary disability insurance program: covered active duty
California expands paid family-leave eligibility for families of service members on training or state active duty.
Workers may receive family temporary disability insurance benefits when they take leave for qualifying needs tied to a broader range of military duty by a spouse, partner, child, or parent.
What the law does
- Expands “covered active duty” for regular Armed Forces members to include training and deployment, not only foreign deployment.
- Expands coverage for reserve-component members, including the National Guard, to include training and federal or state active-duty orders.
- Makes the expanded definition operative when EDD incorporates the relevant provision into its EDDNext integrated claims system or on July 1, 2028, whichever occurs first.
Who it affects
- Workers seeking family temporary disability insurance for a qualifying exigency related to a spouse’s, domestic partner’s, child’s, or parent’s military duty.
- Members of the regular Armed Forces, reserve components, and the National Guard, and their families.
