Bail Consumer Protection Act

California makes it unlawful to pose as a licensed bail agent to solicit bail business.

The Bail Consumer Protection Act targets deceptive bail solicitations, including those made through calls, texts, emails, robocalls, and in person.

What the law does ​

  • Penalizes impersonating or falsely claiming to be a licensed bail agent while soliciting or attempting to solicit bail.
  • Penalizes hiring a person or company to solicit bail when the hirer knew or should have known the solicitor was falsely posing as a licensed bail agent.
  • Allows these penalties to apply alongside other criminal or insurance-law penalties.
