Alcoholic beverages: retail on-sale license: off-sale privileges

California extends restaurant and producer tasting-room takeout alcohol privileges through December 31, 2029.

Eligible businesses can continue selling certain cocktails, wine, and spirits for customer pickup under existing safeguards. The law took effect immediately to avoid a lapse in those privileges.

What the law does ​

  • Extends through December 31, 2029, off-sale pickup privileges for eligible on-sale restaurants, beer manufacturers, wine manufacturers, and craft distillers with bona fide public eating places.
  • Allows manufacturer-prepackaged distilled spirits for pickup and, with a meal, up to two qualifying non-beer drinks in sealed containers.
  • Requires pickup orders to be placed online, by phone, or in person; picked up directly by the ordering customer; and verified with valid identification.
  • Prohibits delivery under these privileges and requires businesses using non-prepackaged drink privileges to notify the Department of Alcoholic Beverage Control.
  • Preserves the Department of Alcoholic Beverage Control's authority to restrict or prohibit these sales for good cause.
