Fairs: contracting
California fairs cannot write service-contract bids or proposals to favor a single bidder.
The law requires fair service contracts to remain competitively available, except for emergencies and live-music bookings. Contracts awarded through prohibited single-bidder restrictions are void.
What the law does
- Bars fairs from issuing service-contract invitations to bid or requests for proposals that directly or indirectly limit bidding to one bidder.
- Allows noncompetitive contracting during emergencies requiring immediate action to protect public health, welfare, safety, or fair property.
- Exempts contracts with musicians or musical groups for live performances.
- Voids contracts awarded in violation of the bidding restriction.
