Civil proceedings: real party in interest
SB 932 requires assignees in civil cases to name the original rights holder in their first court filing.
The law makes clear at the outset whose rights an assignee is pursuing in a proceeding.
What the law does
- Requires an assignee to identify the assignor when the assignor is the original real party in interest.
- Requires that identification in the case title on the assignee’s first filing.
