Department of Transportation: transferred property: City of Lynwood
AB 1338 lets Lynwood move a Caltrans public-use deed restriction to another city parcel to support housing development.
The change may allow housing to move forward on the Imperial Highway site, which the bill identifies as difficult to finance because of soil conditions and its proximity to Interstate 105. It preserves a public-use restriction on a separate Lynwood property.
What the law does
- Requires the Department of Transportation, at Lynwood's request, to agree to remove the 15-year public-purpose deed restriction from the Imperial Highway property if statutory conditions are met.
- Requires Lynwood to place a 45-year deed restriction on the Fernwood Avenue property.
- Conditions the transfer on the Fernwood Avenue property being at least as large and at least as valuable per acre as the Imperial Highway property under the bill's appraisal rules.
- Requires Lynwood to report within one year of an agreement, and annually until projects are complete, on development plans, project status, housing units, affordability, unit sizes, and public financing.
