Employment: sexual harassment training and education: anti-hate speech training

California employers with five or more workers must add anti-hate-speech content to required harassment training beginning January 1, 2028.

The law expands mandatory workplace training to help employees and supervisors recognize, report, and confront speech targeting people for protected characteristics.

What the law does ​

  • Requires anti-hate-speech training as part of the existing sexual-harassment training requirement starting January 1, 2028.
  • Requires practical guidance on workplace speech that vilifies, humiliates, or incites hatred based on protected characteristics.
  • Allows existing training on unlawful harassment and abusive conduct based on protected characteristics to satisfy the new requirement.

Who it affects ​

  • California employers with five or more employees.
  • Supervisory and nonsupervisory employees in California.
  • The Civil Rights Department, which administers the training requirements and may seek compliance orders.
